TERMS AND CONDITIONS

Airtime Advance Product

These Terms and Conditions (“Terms”) govern the Airtime Advance facility (“Facility”) offered by the Bank to eligible customers. By requesting and/or accepting the Airtime Advance, you agree to be bound by these Terms.

1. Definitions

  • “Bank” means GT Bank, a licensed financial institution in Ghana.
  • “Customer” means an eligible account holder of the Bank who applies for and receives the Facility.
  • “Facility” means the short-term airtime credit advanced to the Customer.
  • “Outstanding Amount” means the principal amount advanced plus applicable fees and charges.
  • “Due Date” means the repayment date communicated at the time of disbursement.

2. Eligibility

2.1 The Facility is available only to selected customers of the Bank based on the Bank’s internal eligibility and credit assessment criteria.

2.2 Eligibility does not guarantee approval. The Bank reserves the right to approve or decline any request at its sole discretion.

2.3 The Bank may vary the eligibility criteria at any time without prior notice.

3. Facility Amount

3.1 The minimum and maximum loan amounts shall be determined by the Bank and communicated at the time of request.

3.2 The approved limit may vary from time to time based on account activity, repayment history, and internal credit scoring.

4. Fees and Charges

4.1 A service fee of 3% (or an amount or percentile as may from time to time be solely determined by the Bank) of the approved amount shall apply and will be disclosed to the Customer before acceptance.

4.2 The service fee shall be deducted upfront from the loan amount at disbursement and will not form part of the loan principal or repayment amount.

4.3 The Bank reserves the right to revise its pricing structure subject to regulatory guidelines. Such revisions may be effected by the Bank without prior notice to you.

5. Disbursement

5.1 Upon approval, the Facility amount will be disbursed directly as airtime to the Customer’s registered mobile number.

5.2 The Bank shall not be liable for incorrect mobile numbers provided by the Customer.

6. Repayment

6.1 Unless a different tenor is communicated, the Facility shall be repaid within seven (7) days from the date of acceptance.

6.2 Repayment shall be made through automatic debit from the Customer’s account.

6.3 The Customer authorises the Bank to:

  • Debit their account on the Due Date.
  • Debit any other account of theirs held with the Bank.
  • Recover any outstanding indebtedness under, or arising from, the facility from any inflow into the account until full repayment is made.

6.4 Early repayment is permitted without penalty.

7. Late Payment and Default

7.1 If the Outstanding Amount is not fully repaid on or before the Due Date, the Facility shall be considered overdue, and the Customer shall be deemed to be in breach of these Terms and Conditions.

7.2 In addition, the Bank reserves the right to:

  • Debit customer’s account until full recovery
  • Suspend the Customer’s access to future Airtime Advance requests
  • Report the default to licensed credit bureaus in Ghana
  • Commence recovery proceedings in accordance with applicable laws

7.3 The Customer shall bear all reasonable recovery and legal costs incurred by the Bank in recovering overdue amounts.

8. Customer Authorisations

By accepting the Facility, the Customer irrevocably authorises the Bank to:

  • Debit their account for repayments as and when due, fees, and penalties pursuant to these Terms and Conditions.
  • Set off against any funds of the Customer held with the Bank
  • Share credit information with licensed credit reference bureaus
  • Contact them via SMS, email, phone call, or in-app notification

9. Suspension and Termination

9.1 The Bank may suspend or withdraw the Facility at any time without prior notice to the Customer.

9.2 The Facility may be terminated if:

  • The Customer provides false information
  • The account becomes dormant or restricted
  • The Customer breaches these Terms and Conditions

Termination shall not affect the Bank’s right to recover any outstanding amounts, or to enforce any right(s) that may have accrued under these Terms and Conditions before the said termination.

10. No Waiver

Failure or delay by the Bank to enforce any right shall not constitute a waiver of that right.

11. Limitation of Liability

The Bank shall not be liable for losses, damages, injuries, howsoever described, arising from or caused by:

  • Network failures
  • Delays caused by mobile operators
  • System downtime beyond its control
  • incorrect information provided by the Customer
  • Any other factor that is beyond its control.

12. Amendments

The Bank may amend these Terms and Conditions at any time. Updated Terms will be communicated via any one or more appropriate channel(s) including but not limited to USSD, website, mobile app, or SMS.

Continued use of the Facility after such notice constitutes acceptance of the revised Terms and Condition.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.

14. Dispute Resolution

Any dispute arising out of or in connection with this Facility shall first be resolved amicably through negotiations between the Parties within thirty (30) days of written notice of the dispute. If the dispute is not resolved within that period, it shall be referred to and finally resolved by arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798). The arbitration shall be conducted by a sole arbitrator appointed by agreement of the Parties, failing which the arbitrator shall be appointed by the Ghana Arbitration Centre. The seat of arbitration shall be Accra, Ghana, the language shall be English, and the arbitral award shall be final and binding on the Parties.

15. Acceptance

By selecting “Accept” on USSD, mobile app, or internet banking, you confirm that:

  • You have read and understood these Terms and Conditions.
  • You agree to repay the Facility including applicable fees in line with these Terms and Conditions.
  • You authorise the Bank to debit your account in line with these Terms and Conditions.
